Border Travel Terms & Conditions
BOOKING CONDITIONS
After making a booking with Border Travel, your contract
commences on the receipt of your first payment, The
following booking conditions apply once this contract
commences, It is paramount that you check all the details
very carefully and ensure that all details enclosed within
your confirmation invoice and itinerary are as requested,
CONFIRMATION OF BOOKING
Your booking is subject to confirmation of availability
and price, If we cannot confirm availability or price within
72 hours from receipt of your booking request, we can upon
notice to you terminate the contract between us provided
that we re-pay to you any payments that we have received,
Border Travel reserve the right to inform the user of the
booking termination by telephone or by e-mail, Should the
notification be submitted via telephone or e-mail, it is the
purchaser's responsibility to reply within 24 hours, Border
Travel will not be liable for any failure to respond to the
telephone or e-mail, whether it be negligence on the user's
part, or failure of their Internet or E-mail account
provider or "Host", In the event that we terminate the
contract in these circumstances we shall not have any
liability towards the purchaser, Our right to terminate
pursuant to the proceeding paragraph ceases on the expiry of
72 hours from receipt by us of your booking request, Errors
and Omissions Expected,
CANCELLATIONS
Should you or any member of your party be forced to
cancel your booking once it has been accepted, a valid
cancellation can only be made if you give written
instruction, which must be signed by the lead member of the
party, The effective date for cancellation will be the date
we receive your written instruction at our office. If you
cancel, a cancellation charge (being agreed damages to cover
our estimated loss) becomes payable by you as nominated
leader of the travelling party, N, B, You may be able to
claim under any insurance policy arranged by us for you, if
your cancellation falls within the provision of your
insurance policy, If you cancel, a cancellation charge will
invariably apply, These charges are set by the principals
i.e. Airlines, Hotel, etc, In the first instance it would be
the loss of your non-refundable deposit, However once your
ticket has been issued some principals will charge anything
from 25% to 100% of the cost, fully dependant on the type of
ticket you have purchased, When any part of your journey has
been flown the charges will become 100%, On certain tickets
in addition to this, there will be a non-refundable,
non-changeable ticket restriction and any amendment applied
to that ticket will be deemed as a cancellation,
PRICE CHANGES, SURCHARGES AND SCHEDULE
ALTERATIONS
The price confirmed to you at the time you make your
booking is guaranteed if you pay your full and final
balance, We cannot however guarantee the price until we are
in receipt of full payment, All prices quoted are in pounds
sterling but may be subject to change due to currency or
fuel surcharges, increases in airfare or third party
products or government action, In exceptional circumstances
however, there may be instances where a surcharge is levied
due to "Force Majeure" or other reasons beyond our control,
In the event of a schedule change in your flight we will try
to offer the nearest alternative or, after an
administrational charge, a total refund,
COMPLAINTS
If you have a problem, please inform the Airline, Hotel
or the other supplier concerned immediately, so that they
can endeavour to put things right, If they cannot resolve
the problem, you must contact our UK office immediately by
telephone or fax, so that we are given an opportunity to
help, In the unlikely event that a complaint cannot be
resolved at the time, you should write to us within 30 days
of returning home, giving your original booking reference
number and all the other relevant information, If you fail
to take any of these steps this will hinder our ability to
put the problem right and/or investigate it fully and any
right you may have to receive compensation will be reduced
or completely extinguished, If there is a dispute between us
which cannot be amicably settled it can, if you wish, be
referred to arbitration under a special scheme which,
although devised by arrangement with the Association of
British Travel Agents ("ABTA") is administered quite
independently by the Charter Institute of Arbitrators, This
scheme provides a simple and inexpensive method of
arbitration on documents alone with restricted liability on
you for costs,
Full details are available from ABTA on request, The
scheme does not apply to claims for more than £5000 per person or £5000 per booking form. Nor to claims which are
solely or mainly in respect of physical injury or
illness.
YOUR HOLIDAY CONTRACT
These booking conditions form part of your contract with
us, That contract and any matters arising from it are
governed by Scots Law and subject to the jurisdiction of the
courts of Scotland, Please note that, as between you and any
of the Airlines, Hotels, car rental companies, etc, involved
in providing your tickets, accommodation, car, etc,
different terms and conditions may apply, If you would like
to see a copy of any applicable terms and conditions please
submit your request in writing and we will try to meet it.
MEMBERSHIPS
We are members of the Association of British Travel
Agents ("ABTA") and hold a Air Travel Organiser's Licence
("ATOL") number 3121 issued by the Civil Aviation
Authority.
YOUR FINANCIAL PROTECTION
When you buy an ATOL protected flight from Border Travel Services Ltd you will receive a
confirmation invoice from us
(or via our authorised agent through which you booked) confirming your
arrangements and your protection under our Air Travel Organiser's Licence number 3121.
In the unlikely event of our insolvency, the CAA will ensure that you are not stranded
abroad and will arrange refund any money you have paid to us for an advance booking.
